1. Acceptance of Terms

Welcome to GRV Golf! These Terms of Service (“Terms”) govern your use of the GRV Golf mobile application (“App”) operated by Golfstream West, Inc. (“we,” “us,” or “our”).

By accessing or using our App, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the App.

2. Description of Service

GRV Golf is a golf improvement application that provides:

• Mental training exercises including meditation and visualization
• Journaling features for tracking your golf journey
• Tools for recording and storing personal golf memories through text, photos, videos, and audio
• Golf performance tracking capabilities
• Personalized improvement programs

3. Account Registration

To use certain features of the App, you must register for an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your password
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

You must be at least 13 years old to use this App. By creating an account, you represent that you are at least 13 years of age.

You retain ownership of all content you submit to the App, including:

• Journal entries
• Photos and videos
• Audio recordings
• Performance data

License to Us

By posting content to the App, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and display your content solely for the purpose of operating and improving the App. This license continues until you delete your content or account.

Content Guidelines

You agree not to submit content that:

• Violates any law or regulation
• Infringes on intellectual property rights
• Contains harmful, offensive, or inappropriate material
• Contains malware or harmful code
• Impersonates another person or entity
• Constitutes spam or unauthorized advertising

We reserve the right to remove any content that violates these Terms.

• Attempt to gain unauthorized access to the App or its systems

The App and its original content (excluding user content), features, and functionality are owned by Golfstream West, Inc. and are protected by international copyright, trademark, and other intellectual property laws.

Our trademarks and trade dress may not be used without our prior written permission.

Your use of the App is also governed by our Privacy Policy. Please review our Privacy Policy, which also governs the App and informs users of our data collection practices.

8. Subscriptions and Purchases

Free Access

The App is currently free to use with access to all basic features.

Future Premium Features

We may offer premium features, subscriptions, or in-app purchases in the future. Any such offerings will be subject to additional terms and pricing that will be clearly presented before purchase.

Payment Terms (When Applicable)

• All purchases are final and non-refundable except as required by law
• Subscription renewals will be clearly communicated
• You may cancel subscriptions through your app store account settings

The meditation, visualization, and mental training exercises provided in the App are for informational and entertainment purposes only. Golf Improvement Disclaimer

While our App aims to help improve your golf game, results may vary. We do not guarantee any specific improvement in golf performance.

As-Is Basis

The App is provided on an “as is” and “as available” basis. We make no warranties, expressed or implied, regarding the App's operation, availability, or fitness for a particular purpose.

10. Limitation of Liability

To the maximum extent permitted by law, Golfstream West, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use the App
• Any unauthorized access to or use of our servers
• Any interruption or cessation of transmission to or from the App
• Any bugs, viruses, or harmful code transmitted through the App
• Any errors or omissions in any content

In no event shall our aggregate liability exceed the amount paid by you, if any, for accessing the App in the twelve (12) months preceding the claim.

You agree to defend, indemnify, and hold harmless Golfstream West, Inc. and its officers, directors, employees, and agents from any claims, damages, obligations, losses, liabilities, costs, or expenses arising from:

• Your violation of these Terms
• Your violation of any third party rights
• Your use of the App
• Content you post to the App

12. Modifications to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect.

Your continued use of the App after changes become effective constitutes acceptance of the revised terms.

13. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including breach of these Terms.

Upon termination, your right to use the App will cease immediately. You may delete your account at any time through the App settings or by contacting support.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the App shall be resolved in the state or federal courts located in San Diego County, California.

15. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Golfstream West, Inc. regarding the use of the App.

If you download the App from the Apple App Store, you acknowledge that:

• These Terms are between you and Golfstream West, Inc., not Apple
• Apple has no obligation to provide maintenance or support for the App
• Apple is not responsible for any product warranties
• Apple is not responsible for addressing any claims relating to the App
• Apple is a third-party beneficiary of these Terms with the right to enforce them
